I have a debt that went to collections for approximately $5,000. Last month, the agency called me at work (which i didn%26#039;t know they could do), and wanted me to pay the entire balance in full. I told them I couldn%26#039;t do that (even though the guy on the phone informed me that I had more than enough available credit on my credit cards to pay off the balance), but I could make a payment of $500 on my credit card. I didn%26#039;t want to run up the balances on my credit cards, and offered to start some kind of payment plan, but they said they didn%26#039;t do that. But they did accept my payment of $500. Then they send me a notice a few days ago that at the end of this month, per my authorization (which i never gave them), they%26#039;re going to charge the same credit card the remainder of the balance ($4500). I don%26#039;t even have that much available credit on the card! Can they do this?

First of all Collection Companies CANNOT call you at work if they know you cannot receive calls there. You simply tell them that you are not allowed to get calls at work. If they do so after that, its a violation of the FDCPA
Secondly, you can dispute the charge with your credit card company under the Fair Credit Billing Act.
The credit card company will not be allowed to attempt to collect any money under dispute. They cannot report it as late, or past due while in dispute
until they determine it%26#039;s legit.
The collector will have a hard time proving it was authorized since it was verbal
You can also notify the credit card company not to authorize any charges from that particular company.
Do everything in writing, certified mail, return receipt requested.

Any unauthorized debits can be claimed with your credit card company. You will however, have to prove that you didn%26#039;t authorize it, likewise, the credit card company will have to have some kind of proof that they had permission to submit the debit. It doesn%26#039;t hurt to make the claim. You only have 60 days from the date that the credit card statement was printed, to file a claim. Good Luck.

Credit is very funny! You have to be VERY careful at what you sign into when using a certain type of credit card. Certain crediters can %26quot;stack%26quot; interest, lete fess, anything to make the bill higher. I would contest the 500 and make it known you are not one to be pushed around. Sometimes that all it takes..other wise, be ready to deal with that for a long time. Oh, and YES, they can contact you anywhere you left a phone #.
