Im being sued by a credit card company. Im going to court in 4 days. I didn%26#039;t respond to the court papers because I had a debt settlement company taking care of my debts. Big Mistake. If I contact the attorney do you think they would settle? Do you think they would accept payments over 3 months. The credit card is 6500.00. The credit cards company will have to travel 7 hours for court. Also I contacted a lawyer online, where you ask questions and he did not recommend me contacting them and settling before the date. That I should contact a lawyer, they could represent me in arbitration and see if I have grounds for an appeal. Anyone else experienced this. I was just going to call them tomorrow or fax my offer.
Any advice is greatly appreciated

Debt collectors don%26#039;t file suit in court if the debt is beyond the statute of limitations. They are not that stupid to waste time and money in court.
You Will have a chance to explain your situation to the court regarding that debt settlement company you hired. Remember this, most of those companies either for profit or non profit don%26#039;t always solve your problems.
The court will consider your income and expenises and determine a reasonable payment schedule. Also the credit card company won%26#039;t be traveling 7 hours to court, they will have a local lawyer there to handle the case.
Make sure the court papers are legitimate. They should list the court case number. Call the court to make sure this is a legal law suit. Some companies send out phony court notices. A real court summons is delivered by an agent or the Sheriff to your door for you to sign.

If you decide to contact them, you do not need to sound like an ignorant consumer. I think you should hire a lawyer if you can afford it. Otherwise, I think you should go to court and explain to the judge that you were being advised by a debt settlement company. I don%26#039;t think you should fax a terribly low offer to the credit card company, but that may be worth a shot!

First thing to find out is if the statute of limitations is up in this case. If so that is all you have to state and it will be removed and judgment considered none collectible because of it.If the debt is over 5 years old them most likely is covered. Check it out and do not offer any reimbursement of offer, or admit to any debt until you know. Debt collectors are known for these strategies in order to collect o debts that as past the SOL regulations, and win when those uneducated in the process do not show up, or show up unprepared. Prepare yourself and be aware.

What state are you in?
Has the deadline to file your answer expired yet? How old is this debt? Are you being sued by the original creditor or a collection agency? Why are they suing if you are in a debt settlement program? That is very irregular, but unfortunately it does happen. Did the debt settlement company notify you that the credit card company had refused your settlement? If they did not, then I suggest that you get out of this program and find another one. And I would file a complaint with the Better Business Bureau, too.
If you%26#039;re being sued by the original creditor, winning can be difficult because they are very likely to have a lot of the paperwork that they would need to win. If you%26#039;re being sued by a collection agency, then the standard of proof becomes higher.
I would try to hire an attorney if you can afford it to see if he can buy you some time to get your papers in order and to file some kind of defense. Being unable to pay is not a defense, and maybe an attorney can help you to achieve a settlement with this company. Again, if it is a debt collector, then the standard of proof, as I said, is more difficult for them.
Make sure that you show up for your court date. Maybe you can ask the judge for a continuance so that you can have time to prepare for your case and to get an attorney. If you don%26#039;t show up, the credit card company will win a default judgment. I would also tell the judge that you were in a debt settlement program that unraveled for you. I would even hope your lawyer would bring the debt settlement people into court as witnesses to show that you are making good faith in paying.

I hope you signed up with a reputable debt settlement company. When you enroll yourself in a settlement program you need to have a genuine financial hardship.
Although this is not common, this sort of thing does happen. The credit card company is not stupid either. If they see that you have a big mortgage payment that you are able to keep up with, that is reason enough sometimes for them to file a suit in the court.
But you seem to know what you are doing, the best course of action as others have stated before me, is to go and present yourself in court and make a case in front of the Judge. The Judge will definitely see that you are not being careless, but on the contrary, have hired a professional firm to resolve this matter. You will still settle with them, so hang in there.
