Credit card company threatening to sue elderly mother?

My elderly mother had several credit cards at one time. Some of her relatives used them and she knew nothing about this at the time. At one time, she was with a debt managment group that was trying to help her pay off her credit with this company it is 2,900 dollars. But this credit card company would not go along with the payments she was trying to give them of 300 dollars a month. Now they are threatening to sue her. It%26#039;s horrible in a few days she will be 81 and she has lost most of her memory. And now she has to face this at her age? We live in Texas legally what could they do to her? She own%26#039;s her own home and is a retired teacher. Does anyone have any advice about what to do? Any help would be greatly appreciated.

you should contact a attorney and seek his help, do this immediately! The local prosecuting atty office should be contacted and maybe an investigation into who actually used her cards. There is also bankruptcy court as well ,you should really seek the advice of an attorney

This is some advice that I learned along the way. My mother lives with me now. When she owned her own home we had it put into my name. Just in case she had to go into a nursing home, they could not take her home away. I would suggest that you do this as soon as possible.



In my state her home must be in my name three years before she would go into a nursing home, for it to be effective. This is for your mom%26#039;s safety.



I think the credit card company would have to accept the payment of 300.00 a month. In my state of Wisconsin if we are making payments that is a show of good faith. They cannot send it to collection.



I would probably call a lawyer and have a phone consult about this. Most lawyers do not charge for this. Would need legal advice on this.

Well in the State of Texas ther really is not much they can do, they can not garnish wages, her S.S.I. and retirement are exempt and they can not take her home.

Since when does age matter when it comes to owing money? I don%26#039;t think they particularly care about her memory either. Money owed is money owed and they want their money. Tell the dead beat relatives to pay for their part of the bill.
