My soon to be ex spouse did not list any debt/credit cards or outstanding debt when she turned in her financial disclosure. Since that time I have done a credit report and found out that there are multiple outstanding debt in which she has taken out credit cards in my name. Since that time I have contacted creditors and got balances. Who is responsible for those debts since she failed to disclose the information and I would have had no knowledge if not for the credit report.

get a hold of your lawyer now - tell them about the undisclosed assets %26amp; debts - she can be in serious trouble- stop this now before the irs gets involved- call your divorce attorney or hire a new one. keep all records, keep a record of any phone calls that pertain to these debts or assets

They would be both your responsiblity until a court descides else.



You will have to present it to the court. But its community property since you were married. Find out the opening dates. She may have done this after you have declared you wanted a divorce. If it was done after, you can sue her for spiteful and financial damage to your name..it idenity theft.

Talk to your lawyer, you should be able to take the total of her debt on the CC%26#039;s that she took out in your name out of her share of the divorce settlement. Taking out CC%26#039;s in another persons name is a fraudulent act. If she applied for any of those cards after the divorce was filed, she could be in a peck of trouble.

If she took out credit cards in your name you can get her for itentity theft whether you are married to her or not. I think you need to tell your lawyer what you have found and he will tell you the best route to go, but I do know that she can be in big trouble for getting credit cards in your name if you did not sign for them.

Sorry, if they are in your name, you need to call the credit card companies and let them know that you never authorized these accounts to be opened, then you need to file criminal charges against your soon to be ex for identity theft. Marriage does not entitle your spouse to sign anything for you unless she has power of attorney.

The credit card companies think these are your accounts because your name is what was on the application.



Credit Cards companies are not held to divorce court decisions... the ultimate financial responsiblity lies on the account holder no matter what ANY DIVORCE COURT DETERMINES



You need to:



(1) put a fraud alert on your credit reports, so that you minimize the number of accounts on-going to be opened up without your knowledge, before or after the divorce



(2) contact the credit cards that you didn%26#039;t apply for %26amp; let them know you didn%26#039;t apply for them and ask them to restrict these accounts from any further activity... in order to be released from the debt, you have to (a) file a police report as ID thedt %26amp; (b) press charges against the person who used your identity to fraudulently obtain credit... then you need to also have those Credit Card companies put a password on the accounts, something you know %26amp; she wouldn%26#039;t guess so that she can%26#039;t affect any activity on those accounts



(3) Pray -- really, seriously that she hasn%26#039;t written any bad checks on anything with your name on it... you are responsible for that as well --- call your bank %26amp; change account to only your name with password protection so she can%26#039;t make herself a signator on your account
